Five years after the Taliban returned to power, Afghan women and girls face an increasingly institutionalized system of exclusion affecting education, employment, movement, health care, family life, and access to justice. This article examines the documented human rights violations under Taliban rule, Afghanistan’s obligations under CEDAW and other treaties, the ICC warrants concerning alleged gender persecution, the debate over gender apartheid, and the limits of international accountability.
